Toxic Substance Control Act (TSCA, TOSCA)


The Toxic Substance Control Act (TSCA, TOSCA) provides the Environmental Protection Agency (EPA) the authority to regulate the manufacture, distribution, and use of chemical substances. TSCA requires any person who manufacturers, processes, or distributes in commerce any chemical substance or mixture to keep records of significant reactions to health or the environment that allegedly were caused by the chemical. Records concerning health effects on employees must be kept for thirty (30) years and other records must be retained for five (5) years.

If a company intends to export a chemical that is subject to certain requirements under TSCA, the EPA must be notified. The Agency is responsible for notifying the importing country's government of the export and of EPA's regulatory action or the availability of information. With respect to imports, no chemical substance, mixture, or article containing a chemical substance or mixture will be allowed into the customs territory of the United States if it fails to comply with any TSCA rule or otherwise violates TSCA.

Under TSCA, the EPA must also be notified before a chemical has a Significant New Use (SNU) in industry. Chemical manufacturers cannot produce a chemical without a pre-manufacture notice (PMN) to the EPA, which describes the use of the product.

TSCA requirements generally relate to substances that are produced and distributed in U.S. commerce. However, chemical substances produced in the United States for export only, can be covered by TSCA if the EPA finds that the chemical substance will present an unreasonable risk within the United States. It is possible that the EPA may require the chemical substance to be tested and may further regulate it.

Compliance with TSCA is a matter of submitting the appropriate information to the EPA. RCS, Inc. searches thousands of databases to identify regulatory requirements for each client's products.
